RUTHERFORD COUNTY, TN - In a recent court decision, Marcus Anthony Robey's appeal for post-conviction relief has been denied. The case dates back to 2013 when Robey pleaded guilty to evading arrest and criminal impersonation under a plea agreement, resulting in a sentence of eleven months and twenty-nine days. However, it was a two-part case.

Past Rutherford County Circuit Court records show Robey also faced charges in a robbery case, which was set into motion when he and another man were accused of robbing an employee of Advance Financial on Old Fort Parkway in Murfreesboro. Subsequently, a jury convicted him of aggravated robbery and he pleaded guilty to possession of a weapon by a convicted felon, receiving concurrent thirty and fifteen-year sentences.

Records show the 39-year-old previously filed a petition for post-conviction relief that was denied. Evidently, the court ruled the Petitioner had waived his right to appeal due to his plea agreement and therefore, his appeal was dismissed. This most recent case was met with the same fate, as noted in records filed on November 15, 2023. 

The court's decision outlines the legal background, noting Robey's guilty plea to evading arrest and criminal impersonation, followed by a trial for aggravated robbery. A jury convicted Robey on the aggravated robbery and he pleaded guilty to possession of a weapon by a convicted felon. He then received concurrent thirty and fifteen-year sentences, respectively. Despite a subsequent attempt to withdraw his guilty plea, Robey's appeal for post-conviction relief was ultimately denied.

The Court of Criminal Appeals of Tennessee sided with a previous post conviction court's judgment and the denial was filed by the Clerk of the Appellate Courts last month. The details of Robey's case highlight the complexities of legal proceedings and the consequences of plea agreements. Again, the most recent appeal was denied.
